Terms and Conditions for International Customers - The Mahal Fashions E-commerce Pty Ltd.

 

1. Introduction: 1.1 We: Refers to The Mahal E-Com Pty Ltd, a company incorporated under the registered office at Suite 1, 64 Oxford Rd, Ingleburn NSW 2565, Australia. 1.2 You: Refers to the person using our site to purchase goods from us. If under 18, permission from a parent or guardian is required before registering or making purchases.

2. Ordering Goods: 2.1 A legally binding contract is formed when you buy goods on our site. 2.2 Registration with accurate information is required, and you must keep your password secure. 2.3 Orders are placed by adding items to the shopping bag, proceeding to checkout, and clicking "Pay." 2.3.1 Order acknowledgement does not confirm acceptance; we may contact you for various reasons. 2.3.2 Acceptance is confirmed by email, creating a binding contract, and dispatching the goods.

3. Delivery and Cancellation: 3.1 Orders cannot be canceled once placed; the contract is completed upon order receipt. 3.2 Delivery method chosen during checkout is used. 3.3 Estimated delivery date provided is an estimate, not a guarantee. 3.4 If delivery fails, alternative arrangements will be made, or a refund will be provided. 3.5 Goods may be delivered in instalments.

4. Payment: 4.1 Accepted payment methods: Visa Debit, Visa, MasterCard, AMEX, Afterpay, Zippay, and PayPal. 4.2 Reasonable measures are taken for secure payment information. 4.3 Card is charged upon order placement. 4.4 Price is in the currency displayed at checkout, and you're responsible for any associated charges. 4.5 Incorrect pricing or product information may result in order cancellation or price modification.

5. Nature of the Goods: 5.1 Weights, sizes, and measurements are accurate but may have small differences. 5.2 Colors displayed may vary on different monitors. 5.3 Hand-finished or embroidered garments may have small irregularities and are not designed for hard wear. 5.4 Packaging may differ from the website.

6. Made-to-Measure and Altered Garments: 6.1 Changes to specifications after order confirmation may incur additional fees.

7. Returns or Exchanges: 7.1 Returns or refunds only accepted for faulty goods if reported within 7 days of delivery. 7.2 Contact customercare@themahalfashions.com to initiate returns for faulty goods. 7.3 Customer is responsible for return costs. 7.4 Repaired or replaced goods delivered at no additional cost.

8. End of the Contract: Termination doesn't affect rights to receive owed money.

9. Limit on Our Responsibility: 9.1 Except for legal responsibilities, our liability is limited to the amount paid for goods and delivery. 9.2 Business losses are not covered.

10. Disputes: 10.1 We aim to resolve disputes efficiently. 10.2 Contact us promptly for any issues.

11. Content:

  • Content accuracy is not guaranteed.
  • Use of the site grants no rights to intellectual property.
  • Reproduction or redistribution of content is prohibited.

12. Third-Party Rights: Only parties to the contract can enforce its terms.

13. Our Right to Amend Terms: We reserve the right to change terms with immediate effect.

14. Discounts & Promotions:

  • Discounts vary, and price adjustments on sale items are not offered.
  • Promotion codes are non-transferable and subject to expiration.

15. Indemnity & Circumstances Beyond Control:

  • Not liable for failure or delay due to events beyond reasonable control.
  • Force Majeure Events include various uncontrollable circumstances.
  • Performance under the contract is suspended during Force Majeure Events.
